M\u00fclkiyet hakk\u0131, Anayasa m.35\u2019te \u201c<em>Herkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir. Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir. M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz<\/em>\u201d \u015feklinde g\u00fcvence alt\u0131na al\u0131n\u0131rken A\u0130HS 1 Nolu Ek Protokol m.1\u2019de \u201c<em>Her ger\u00e7ek ve t\u00fczel ki\u015finin mal ve m\u00fclk dokunulmazl\u0131\u011f\u0131na sayg\u0131 g\u00f6sterilmesini isteme hakk\u0131 vard\u0131r. Bir kimse, ancak kamu yarar\u0131 sebebiyle ve yasada \u00f6ng\u00f6r\u00fclen ko\u015fullara ve uluslararas\u0131 hukukun genel ilkelerine uygun olarak mal ve m\u00fclk\u00fcnden yoksun b\u0131rak\u0131labilir<\/em>\u201d \u015feklinde g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, devletlerin egemenlik yetkisi dahilinde olsa da kamula\u015ft\u0131rma yapmalar\u0131 belirli \u015fartlara ba\u011flanm\u0131\u015f durumdad\u0131r.<\/p><p>Bu kapsamda, ilgili A\u0130HS maddesi uyar\u0131nca kamula\u015ft\u0131rman\u0131n kamu yarar\u0131 sebebiyle ve yasada \u00f6ng\u00f6r\u00fclen ko\u015fullara ve uluslararas\u0131 hukukun genel ilkelerine uygun olarak yap\u0131lmas\u0131 zorunludur. Kamula\u015ft\u0131rma s\u0131ras\u0131nda bu \u015fartlara uyulmad\u0131\u011f\u0131 takdirde, ki\u015filerin m\u00fclkiyet haklar\u0131 ihlal edilmi\u015f olmakla birlikte idarenin kamula\u015ft\u0131rma i\u015flemi de hukuka ayk\u0131r\u0131 olacakt\u0131r. T\u00fcrk hukukunda da kamula\u015ft\u0131rmalar\u0131n yasal \u00e7er\u00e7eveye uygun olmas\u0131 ad\u0131na 2942 say\u0131l\u0131 Kamula\u015ft\u0131rma Kanunu d\u00fczenlemesi bulunmaktad\u0131r. Bu Kanun\u2019un \u201cAma\u00e7 ve Kapsam\u201d maddesi \u015fu \u015fekildedir:<\/p><p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Kamula\u015ft\u0131rma Kanunu m.1:<\/strong><\/p><p>\u201c<em>Bu Kanun; kamu yarar\u0131n\u0131n gerektirdi\u011fi hallerde ger\u00e7ek ve \u00f6zel hukuk t\u00fczelki\u015filerinin m\u00fclkiyetinde bulunan ta\u015f\u0131nmaz mallar\u0131n, Devlet ve kamu t\u00fczelki\u015filerince kamula\u015ft\u0131r\u0131lmas\u0131nda yap\u0131lacak i\u015flemleri, kamula\u015ft\u0131rma bedelinin hesaplanmas\u0131n\u0131, ta\u015f\u0131nmaz mal\u0131n ve irtifak hakk\u0131n\u0131n idare ad\u0131na tescilini, kullan\u0131lmayan ta\u015f\u0131nmaz mal\u0131n geri al\u0131nmas\u0131n\u0131, idareler aras\u0131nda ta\u015f\u0131nmaz mallar\u0131n devir i\u015flemlerini, kar\u015f\u0131l\u0131kl\u0131 hak ve y\u00fck\u00fcml\u00fcl\u00fckler ile bunlara dayal\u0131 uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm usul ve y\u00f6ntemlerini d\u00fczenler<\/em>.\u201d<\/p><p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, Kamula\u015ft\u0131rma Kanunu, idarece yap\u0131lacak kamula\u015ft\u0131rma i\u015flemlerinin usul ve esaslar\u0131n\u0131 detayl\u0131 bir \u015fekilde d\u00fczenlemektedir. Bu ba\u011flamda Kamula\u015ft\u0131rma Kanunu geni\u015f kapsaml\u0131 bir Kanun oldu\u011fundan, bu yaz\u0131da kamu yarar\u0131 karar\u0131n\u0131 takiben ger\u00e7ekle\u015fecek s\u00fcre\u00e7 ve sat\u0131n alma usul\u00fc \u00e7er\u00e7evesinde bir a\u015fama olan uzla\u015fma uygulamas\u0131 ile uzla\u015fma sa\u011flanamamas\u0131 halinde s\u00f6z konusu olan dava yolu ele al\u0131nacakt\u0131r.<\/p><p><strong>Kamu Yarar\u0131 Karar\u0131 ve Takiben Ger\u00e7ekle\u015fecek S\u00fcre\u00e7<\/strong><\/p><p>\u0130dare yapmakla y\u00fck\u00fcml\u00fc bulundu\u011fu kamu hizmetlerinin y\u00fcr\u00fct\u00fclmesi ad\u0131na gerekli olan ta\u015f\u0131nmaz mallar\u0131 kamu yarar\u0131 gerek\u00e7esiyle kamula\u015ft\u0131rabilmektedir. Bu do\u011frultuda, Kamula\u015ft\u0131rma Kanunu\u2019nun 5.maddesinde say\u0131lan idari merciler, kamu yarar\u0131 karar\u0131 vermektedir ve kamula\u015ft\u0131rma s\u00fcreci bu \u015fekilde ba\u015flamaktad\u0131r. Bunu takiben Kanunu\u2019nun 6.maddesinde kamu yarar\u0131 karar\u0131n\u0131n hangi mercilerin onay\u0131 ile tamamlanaca\u011f\u0131 d\u00fczenlenmi\u015ftir.<\/p><p>\u0130lgili Kanun\u2019un 7.maddesinde ise, sat\u0131n alma usul\u00fcne ge\u00e7ilmeden yap\u0131lacak i\u015flemler ve idari \u015ferh hususlar\u0131 d\u00fczenlenmi\u015ftir. Bu maddeye g\u00f6re \u201c\u0130dare kamula\u015ft\u0131rma karar\u0131 verdikten sonra kamula\u015ft\u0131rman\u0131n tapu siciline \u015ferh verilmesini kamula\u015ft\u0131rmaya konu ta\u015f\u0131nmaz mal\u0131n kay\u0131tl\u0131 bulundu\u011fu tapu idaresine bildirir\u201d d\u00fczenlemesi yap\u0131lm\u0131\u015ft\u0131r. Bu idari \u015ferh, verildi\u011fi tarihten itibaren alt\u0131 ay i\u00e7inde kamula\u015ft\u0131rma bedelinin tespitiyle idare ad\u0131na tescili iste\u011finde bulunuldu\u011funa dair mahkemeden al\u0131nacak belge tapu idaresine ibraz edilmedi\u011fi takdirde, resen silinecektir.<\/p><p><strong>Sat\u0131n Alma Usul\u00fc ve Uzla\u015fma Uygulamas\u0131<\/strong><\/p><p>Sat\u0131n alma usul\u00fc Kamula\u015ft\u0131rma Kanunu\u2019nun 8.maddesinde d\u00fczenlenmi\u015ftir. Bu madde uyar\u0131nca \u201c<em>\u0130darelerin, bu Kanuna g\u00f6re, tapuda kay\u0131tl\u0131 olan ta\u015f\u0131nmaz mallar hakk\u0131nda yapaca\u011f\u0131 kamula\u015ft\u0131rmalarda sat\u0131n alma usul\u00fcn\u00fc \u00f6ncelikle uygulamalar\u0131 esast\u0131r<\/em>\u201d denilmektedir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, idarelerin kamula\u015ft\u0131rma karar\u0131 verdikten sonra sat\u0131n alma usul\u00fcn\u00fc \u00f6ncelikle uygulamalar\u0131 gerekmektedir. Sat\u0131n alma usul\u00fc \u00f6ncelikle uygulanmad\u0131\u011f\u0131 zaman idarece yap\u0131lan kamula\u015ft\u0131rma i\u015flemi sakat bir i\u015flem olacakt\u0131r. Bu do\u011frultuda sat\u0131n alma usul\u00fcnde takip edilecek s\u00fcre\u00e7 a\u015fa\u011f\u0131da ele al\u0131nacakt\u0131r.<\/p><p>Kamula\u015ft\u0131rma karar\u0131 al\u0131nd\u0131ktan sonra, idarece Kanun\u2019da yer alan bedel tespit esaslar\u0131 \u00e7er\u00e7evesinde ta\u015f\u0131nmaz mal\u0131n tahmini de\u011ferinin belirlenmesi \u00fczere en az \u00fc\u00e7 ki\u015fiden te\u015fekk\u00fcl edecek bir veya birden fazla k\u0131ymet takdiri komisyonu olu\u015fturur. Ayr\u0131ca idare, tahmin edilen bedel \u00fczerinden pazarl\u0131kla sat\u0131n alma ve trampa i\u015flemlerini y\u00fcr\u00fctmek ve sonu\u00e7land\u0131rmak \u00fczere kendi b\u00fcnyesi i\u00e7inden en az \u00fc\u00e7 ki\u015fiden te\u015fekk\u00fcl eden bir veya birden fazla uzla\u015fma komisyonunu g\u00f6revlendirir.<\/p><p>Bu a\u015famay\u0131 takiben k\u0131ymet takdiri komisyonunca belirlenen tahmini bedel belirtilmeksizin ta\u015f\u0131nmaz\u0131n pe\u015fin, taksitle ve pazarl\u0131kla sat\u0131n al\u0131nmas\u0131 veya idareye ait ba\u015fka bir ta\u015f\u0131nmazla trampa edilmesi iste\u011fi resmi taahh\u00fctl\u00fc bir yaz\u0131yla malike bildirilir. Malik veya yetkili temsilcisi taraf\u0131ndan, bu yaz\u0131n\u0131n tebli\u011f tarihinden itibaren on be\u015f g\u00fcn i\u00e7inde kamula\u015ft\u0131rmaya konu ta\u015f\u0131nmaz mal\u0131 pazarl\u0131kla ve anla\u015farak satma veya trampa iste\u011fi idareye bildirildi\u011fi takdirde, komisyonca belirlenen g\u00fcnde pazarl\u0131k g\u00f6r\u00fc\u015fmeleri yap\u0131l\u0131r.<\/p><p>Tespit edilen tahmin\u00ee de\u011feri ge\u00e7memek \u00fczere bedelde veya trampada anla\u015fmaya var\u0131lmas\u0131 h\u00e2linde, yap\u0131lan bu anla\u015fmaya ili\u015fkin bir tutanak d\u00fczenlenir ve bu tutanak tapuda idare ad\u0131na yap\u0131lacak tescilin hukuki sebebi say\u0131l\u0131r. Alt\u0131n\u0131 \u00e7izilmelidir ki, sat\u0131n alma usul\u00fc uyar\u0131nca sat\u0131n al\u0131nan veya trampa edilen ta\u015f\u0131nmaz mal, kaynak veya irtifak hakk\u0131, sahibinden kamula\u015ft\u0131rma yolu ile al\u0131nm\u0131\u015f say\u0131l\u0131r ve bu \u015fekilde yap\u0131lan kamula\u015ft\u0131rmaya veya bedeline kar\u015f\u0131 itiraz davalar\u0131 a\u00e7\u0131lamaz.<\/p><p><strong>Uzla\u015fma Sa\u011flanamamas\u0131 Halinde Takip Edilecek Dava S\u00fcreci <\/strong><\/p><p>Anla\u015fma olmamas\u0131 halinde ise, Kamula\u015ft\u0131rma Kanunu\u2019nun 10.maddesinde d\u00fczenlenen usul s\u00f6z konusu olur. Bu usul kamula\u015ft\u0131rma bedelinin mahkemece tespiti ve ta\u015f\u0131nmaz mal\u0131n idare ad\u0131na tescili usul\u00fcd\u00fcr. Bu usulde idare ta\u015f\u0131nmaz mal\u0131n kamula\u015ft\u0131rma i\u015flemi \u00e7er\u00e7evesinde toplad\u0131\u011f\u0131 belgelerle birlikte ta\u015f\u0131nmaz mal\u0131n bulundu\u011fu yer asliye hukuk mahkemesine ba\u015fvurur ve ta\u015f\u0131nmaz mal\u0131n kamula\u015ft\u0131rma bedelinin tespitiyle, bu bedelin, pe\u015fin veya kamula\u015ft\u0131rma 3.maddenin ikinci f\u0131kras\u0131na g\u00f6re yap\u0131lm\u0131\u015f ise taksitle \u00f6denmesi kar\u015f\u0131l\u0131\u011f\u0131nda, idare ad\u0131na tesciline karar verilmesini ister.<\/p><p>Bu \u015fekilde g\u00f6r\u00fclecek davada taraflar\u0131n bedelde anla\u015famamalar\u0131 halinde, mahkemece atanan bilirki\u015filer, taraflar ve di\u011fer ilgililerin beyan\u0131n\u0131 da dikkate alarak, Kanun\u2019da yer alan kamula\u015ft\u0131rma bedelinin tespiti esaslar\u0131 do\u011frultusunda ta\u015f\u0131nmaz mal\u0131n de\u011ferini belirten raporlar\u0131n\u0131 on be\u015f g\u00fcn i\u00e7inde mahkemeye sunar. Belirtilmelidir ki, uzla\u015fma komisyonunda taraflarca \u00fczerinde g\u00f6r\u00fc\u015f\u00fclen fiyatlar, dava a\u015famas\u0131nda taraflar a\u00e7\u0131s\u0131ndan ba\u011flay\u0131c\u0131 olmad\u0131\u011f\u0131 gibi mahkemece ta\u015f\u0131nmaz\u0131n de\u011ferinin belirlenmesinde de g\u00f6z \u00f6n\u00fcne al\u0131nmaz. Yarg\u0131tay\u2019\u0131n s\u00fcregelen i\u00e7tihatlar\u0131 da bu y\u00f6ndedir.<\/p><p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>YARGITAY HUKUK GENEL KURULU, E. 2010\/18-43 K. 2010\/53 T. 3.2.2010:<\/strong><\/p><p>\u201c<em>Kamula\u015ft\u0131rma Yasas\u0131n\u0131n 4650 Say\u0131l\u0131 Yasa ile de\u011fi\u015fik 8. maddesi h\u00fckm\u00fc uyar\u0131nca kamula\u015ft\u0131rmay\u0131 yapan idare ile mal sahibinin yapacaklar\u0131 pazarl\u0131k sonucu anla\u015fmalar\u0131 halinde uzla\u015facaklar\u0131 bedel \u00fczerinden kamula\u015ft\u0131r\u0131lan ta\u015f\u0131nmaz\u0131n m\u00fclkiyetinin idareye devri m\u00fcmk\u00fcn ise de, anla\u015fma sa\u011flanamamas\u0131 veya var\u0131lan anla\u015fmaya ra\u011fmen tapuda fera\u011f\u0131 verilmemesi durumunda ayn\u0131 maddenin son f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere kamula\u015ft\u0131rma bedelinin, 10. madde h\u00fck\u00fcmleri \u00e7er\u00e7evesinde idarenin ba\u015fvurusu \u00fczerine mahkemece tespit edilmesi ve tespit edilen bu bedelin hak sahibine \u00f6denmesi gerekir. <strong>Yasan\u0131n 8. maddesi \u00e7er\u00e7evesinde uzla\u015fma komisyonu ile ta\u015f\u0131nmaz sahibi aras\u0131nda yap\u0131lacak pazarl\u0131kta teklif edilen ve kabul edilen fiyatlar, taraflar y\u00f6n\u00fcnden ba\u011flay\u0131c\u0131 olmad\u0131\u011f\u0131 gibi mahkemece ta\u015f\u0131nmaz\u0131n de\u011ferinin belirlenmesinde g\u00f6zetilecek bir \u00f6l\u00e7\u00fct de de\u011fildir.<\/strong><\/em><strong>\u201d<\/strong><\/p><p>Di\u011fer taraftan, ta\u015f\u0131nmaz\u0131 kamula\u015ft\u0131rma i\u015flemine konu olan hak sahiplerinin idari yarg\u0131da bu i\u015fleme kar\u015f\u0131 iptal davas\u0131 a\u00e7mas\u0131 da m\u00fcmk\u00fcnd\u00fcr. Ancak, kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 hak sahipleri taraf\u0131ndan idari yarg\u0131da iptal davas\u0131 a\u00e7\u0131lmas\u0131 ve idari yarg\u0131 mahkemelerince de y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmesi halinde idari yarg\u0131da a\u00e7\u0131lan dava asliye hukuk mahkemesinde g\u00f6r\u00fclen davada bekletici mesele yap\u0131labilir.<\/p><p><strong>Sonu\u00e7<\/strong><\/p><p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, \u00fclkemizde A\u0130HS d\u00fczenlemesine paralel olarak kamula\u015ft\u0131rma i\u015flemlerinin kamu yarar\u0131 g\u00f6zetilerek yasal \u00e7er\u00e7evede yap\u0131lmas\u0131 anlay\u0131\u015f\u0131 hakimdir. Bu do\u011frultuda Kamula\u015ft\u0131rma Kanunu\u2019nda kamula\u015ft\u0131rma i\u015flemlerinin usul ve esaslar\u0131 belirtilmi\u015ftir. Yaz\u0131m\u0131z\u0131n konu edindi\u011fi kamula\u015ft\u0131rmada uzla\u015fma uygulamas\u0131 ise \u00e7a\u011fda\u015f hukuk devletlerinde g\u00f6r\u00fclen bir uygulama olup devlet ile \u00f6zel hukuk ki\u015filerini olabildi\u011fince e\u015fit konuma getirmektedir.
